ABSTRACT:
This paper discusses the application of judicial mortgage as useful measure the effectiveness of implementation, especially after the implementation of Precedent 375 of the STJ. The judicial mortgage assures the plaintiff law sequel (He who has the holder of a right to seize what belongs to him and remove him from power of him who holds) on the lien of the goods sold (burden, charge) and excludes fraud enforcement. Provided for in art. 466 of the Civil Procedure Code, judicial mortgage has not been used for judges and lawyers, at which to evaluate its usefulness for the effectiveness of implementation. The implementation of Precedent 375 of the Superior Court of Justice - STJ, on this occasion, comes to rescue the relevance of this institute forgotten by judicial practice.
