RESUMO
O objeto de estudo do presente trabalho é a Ação Coletiva para tutela de Interesses
Individuais Homogêneos, prevista nos artigos 91 a 100 do Código de Defesa do
Consumidor. Foram analisados alguns aspectos gerais da tutela coletiva como as formas de tutela existentes no CDC, a aplicabilidade da Lei da Ação Civil Pública e do Código de Processo Civil, a legitimidade ativa coletiva e o principio da máxima amplitude da tutela jurisdicional coletiva, para posteriormente enfrentarmos o tema ora proposto com a análise do conteúdo dos artigos mencionados, no intuito da formação de uma convicção a cerca da efetividade e adequação desta modalidade de ação coletiva.

ABSTRACT
The object of study of the present work is the Class Action for guardianship of
Homogeneous Individual Interests, foreseen in articles 91 the 100 of the Code of
Defense of the Consumer. Some general aspects of the collective guardianship had been analyzed as the existing forms of guardianship in the CDC, the applicability of the Law of the Public Civil Action and the Code of Civil Action, the collective active legitimacy and the beginning of the maximum magnifying of the collective jurisdictional guardianship, later to face the considered subject however with the analysis of the content of mentioned articles, in the intention of the formation of a certainty circa the effectiveness and the adequacy of this modality of class action.
