Princípios e fundamentos do salário-maternidade no Brasil1

Resumo: O benefício ora amparado desde os primórdios visa proteger o mercado de trabalho feminino, o mencionado tem grande abrangência, cabível não somente com o nascimento, também havendo adoção, ou até mesmo nos casos de natimorto, e aborto não criminoso. O salário-maternidade é o único benefício previdenciário que integra o salário de contribuição. Sobre ele incidirá normalmente as contribuições previdenciárias. Será discutido no presente a natureza deste benefício, o qual será feito por meio de revisão bibliográfica. Há também o auxílio maternidade oferecido pela recente Lei Orgânica da Previdência Social – LOAS, oferecendo às gestantes de baixa renda que não possui qualidade de segurada da Previdência Social, acompanhamento médico e provendo suplementos alimentares, como forma de proteção a vida. Discutirá também o valor máximo pago pela Previdência Sócial a título de salário maternidade, e quantas parcelas é cabível para o mesmo.

Principles and foundations of maternity benefit in Brazil

Abstract: The benefit now supported from the beginning is to protect the female labor market, that has great scope, applicable not only at birth, there is more adoption, or even in cases of stillbirth, not criminal.
