Fideicomisso

Direciona-se a transmissão dos bens para o herdeiro do herdeiro, a vontade do testador ultrapassa o próprio herdeiro. Essa situação recebe o nome de fideicomisso. O testador também pode ser chamado de fiduciante, ele é o autor da herança, que institui o fideicomisso por meio do testamento. Já o fiduciário é o primeiro herdeiro, em primeiro grau, recebe o bem em caráter temporário, sob a condição ode passá-lo a alguém que talvez não exista ainda. Fideicomissário é o herdeiro de segundo grau, herdeiro final dos bens. Quem nem sequer nasceu é herdeiro eventual na sucessão.
