O DIREITO ALTERNATIVO

RESUMO Alternativa é um esquema resolutivo não convencional de um problema que não teve solução convencional. É uma opção de inaceitação do usual. Transpondo o alternativo para o plano jurídico, vemos que, dada à crise do Direito Dogmático, isto é, em virtude da insuficiência do Estado na resolução de conflitos, surgem novas formas de enfrentar tal situação. E uma dessas formas é o Direito Alternativo.
Sem ética e justiça não há Direito, é desse premissa que o Direito Alternativo parte, dizendo assim que não deve restringir-se em analisar a letra fria da lei, mas sim dar preeminência, na interpretação da norma, ao justo e á realização da justiça, já que sem ética e justiça não há direito.
O direito alternativo, ao contrário do que muitos pensam, não é um anti-direito, a negação da ordem jurídica, outro direito. Ele parte da norma para recriá-la, revitalizando-a, dando-lhe calor, substância, substrato, vida.

ABSTRACT
An alternative is an unconventional layout resolvent of a problem that had no conventional solution. It is an option inaceitação than usual. And one of those ways is the Alternative Law.

The right alternative, contrary to what many think, is not an anti-law, the denial of legal, other right. It departs from the norm to recreate it, revitalize it, giving it warmth, substance, substratum, life.
