Aspectos da competência jurisdicional penal Internacional*

A evolução dos direitos humanos, após a Segunda Guerra Mundial, possibilitou a redemocratização da teoria do Estado e sua relação com o indivíduo – expressão máxima do poder e destinatário de todas as relações internacionais. Nesse sentido, a história demonstrou que o Estado, muitas vezes, não é capaz de garantir a inviolabilidade dos direitos fundamentais dos seus cidadãos, os quais são vítimas de graves crimes. Surge, então, para toda a comunidade internacional, fundamentadamente no exercício da competência jurisdicional universal, porquanto esses crimes afetam toda a humanidade, a tarefa de julgar os criminosos. O processo democrático do tratamento dos criminosos graves impende afirmar que o exercício da jurisdição universal é o único instrumento capaz de garantir a paz à humanidade.

ABSTRACT
The evolution of the human rights, after the World War II, made possible the redemocratic of the theory about State and its relation with the individual - maximum expression of the power and addressee of all the international relations. In this sense, the history demonstrated that the State, many times, is not capable to guaranteeing the inviolability of the basic rights of its citizens that are victims of serious crimes. It appears, then, for all the international community, based in the exercise of the universal jurisdictional competency, inasmuch as these crimes affect all the humanity, the task to judge the criminals. The democratic process of the treatment of the serious criminals made to affirm the exercise of the universal jurisdiction is the only instrument capable to guaranteeing the peace to the humanity.
