RESUMO

A arbitragem é uma das formas de solução de conflitos e tem aplicabilidade nos conflitos coletivos trabalhistas de forma pacífica. No entanto, há controvérsia quanto à sua utilização no âmbito dos conflitos individuais do trabalho. O objetivo deste trabalho é analisar a problemática que envolve a aplicabilidade da arbitragem nos conflitos individuais do trabalho à luz da doutrina, da jurisprudência e dos princípios da proteção e da indisponibilidade dos direitos trabalhistas.

ABSTRACT

Arbitration is a form of conflict resolution and has applicability in collective labor conflicts peacefully. However, there is controversy regarding its use in the context of individual labor disputes. The objective of this work is to analyze the problem involving the applicability of the arbitration in the conflicts of the individual work in the light of the doctrine, jurisprudence and the principles of protection and unavailability of labor rights.
