EMBRIAGUEZ AO VOLANTE: MEIOS DE PROVA ADMITIDOS1

RESUMO

O presente artigo tem por objeto a análise sobre embriaguez ao volante e a polêmica envolvendo o exame do etilômetro, ou seja, o teste do “bafômetro”. A embriaguez ao volante é um tema muito discutido e com muitas controvérsias na própria lei, a recente alteração na Lei 9.503/97 pela Lei 11.705, de 06 de junho de 2008, trouxe novas diretrizes ao crime de embriaguez ao volante, refletindo sobre o delito de homicídio culposo e lesão corporal culposa na direção de veículo automotor, como também na infração administrativa. A aplicabilidade destes dispositivos será discorrida neste trabalho em breves comentários.

ABSTRACT

The present article has for object the analysis on drunkeness to the projection and the controversy involving the examination of etilômetro, that is, the test of “bafômetro”. The drunkeness to the projection is a subject very argued and with many controversies in the proper law, the recent alteration in Law 9,503/97 for Law 11,705, of 06 of June of 2008, brought new lines of direction to the crime of drunkeness to the projection, reflecting on the delict of involuntary manslaughter and guilty assault and battery in the direction of automachine vehicle, as well as in the administrative infraction. The applicability of these devices will be discoursed in this work in brief commentaries.

1. INTRODUÇÃO
