RESUMO
A temática do presente trabalho consiste no estudo das incompatibilidades das normas existentes no Tribunal Penal Internacional e na Constituição da República Federativa do Brasil. É sabido que a pena de morte e a prisão perpétua são vistas de forma diferente na jurisdição brasileira e no Estatuto de Roma, todavia, o Brasil se tornou signatário deste, o que de forma abstrata implica na aceitação das normas do Estatuto quando os dispositivos legais brasileiros forem insuficientes ou falhos quanto ao julgamento de indivíduos que violam as normas estabelecidas no ordenamento jurídico brasileiro. Ademais, enfatiza-se no referido trabalho os pontos debatidos entre juristas que estudam o assunto, bem como membros da própria Corte Internacional e suas considerações acerca das incompatibilidades de normas nacionais com as internacionais.

ABSTRACT
The theme of this work is to study the incompatibility of existing standards in the International Criminal Court and the Constitution of the Federative Republic of Brazil. It is known that the death penalty and life imprisonment are seen differently in Brazilian jurisdiction and the Rome Statute, however, Brazil became a signatory of the Statute, which abstractly constitutes acceptance of the norms of the Statute when Brazilian standards insufficient or failures regarding the prosecution of individuals who violate the rules established in the Brazilian legal system. Furthermore, it is emphasized in that work the points debated by jurists studying the subject, as well as members of the International Court and its own considerations about the
