Abstract: Punishment is a form of rebuke to those who commit unlawful acts, caused physical damage and / or moral to others, disturbed the order, denigrated public property or private.It is the manner in which the state deliberately harms someone who broke the law.The big question is made about the need and purpose of punishment. Two theories of punishment aimed at answering these questions, the retributive theory and utilitarian theory.Utilitarianism justifies punishment only when it leads to good consequences, such as reducing crime, the damage and suffering it causes. It says that the retributive criminal deserves to be punished regardless of the consequences of the punishment. It is concluded that the criminal should be punished but, since this punishment have effecton both the individual and society.
