UMA ANÁLISE SOBRE A INSTITUIÇÃO DE FERIADOS RELIGIOSOS NO BRASIL À LUZ DOS PRINCÍPIOS CONSTITUCIONAIS DA LAICIDADE E DA ISONOMIA.

RESUMO: A partir da formação do Estado Democrático de Direito, consagrado pela Constituição brasileira de 1988, houve e há um apelo diante das garantias sociais, que devem ser fomentadas e asseguradas pelo Estado. Dentre essas garantias, uma das temáticas que mais demonstra complexidade nos dias atuais é a instituição de feriados religiosos devido à característica do Estado laico. Não se limitando a discussão da constitucionalidade, ou não, dos feriados religiosos, há que se analisar, portanto, como a legislação que institui os feriados religiosos vem refletindo na sociedade brasileira e nas garantias constitucionais.

ABSTRAT: From the formation of the democratic rule of law enshrined in the Brazilian constitution of 1988 and there was an appeal on social guarantees, which must be developed and provided by the State. Among these guarantees, one of the themes that demonstrates more complexity today is the establishment of religious holidays due to the characteristic of the secular nation state. No discussion on the constitutionality of such holidays have limited themselves to figure out how the current law has been presenting reflections on Brazilian society and constitutional guarantees.
