União Estável Homoafetiva

RESUMO
Por mais que as uniões homoafetivas tenham sido alvo de muitos preconceitos, a luta pela aplicação dos direitos humanos tem se mostrado vitoriosa e os tribunais vem reconhecendo alguns direitos, a partir da convivência em comum, direitos esses contidos no contexto legal. A convivência de pessoas do mesmo sexo fez nascer polêmicos Projetos de Lei. O propósito de dar as parcerias homossexuais status de união estável possui fundamento, no reconhecimento dos direitos de todo o ser humano, além de deveres e obrigações, protegendo assim, disposições de caráter patrimonial, a propriedade construída pelos parceiros e o direito à adoção, garantindo ainda o direito de sucessão nos bens do parceiro falecido, marcando assim, a saída da clandestinidade destas relações e a regulamentação, como entidade familiar, que são baseados nos direitos fundamentais do ser humano.

ABSTRACT
No matter how much the unions gays have been objective of many prejudices, the fight of the human rights is being victorious and the tribunals are recognizing some rights starting from the coexistence in common, rights those contained in the legal context. The people's of the same sex coexistence made to be born controversial bills. The purpose of giving the partnerships homosexuals status of stable union possesses foundation in the recognition of the whole human being rights besides duties and obligations, protecting like this dispositions of patrimonial character, the property built by the partners and the right to the adoption, still guaranteeing the succession right in the died partner's goods, marking like this the exit of the secrecy of these relationships and the regulation as family entity that you/they are based on the human being fundamental rights.
