Responsabilidade Penal da Pessoa Jurídica no Direito Ambiental

RESUMO

O presente trabalho trata da responsabilidade penal das pessoas jurídica no Direito Ambiental, tema que, embora acolhido pela Constituição Federal de 1988, ainda gera múltiplas discussões na doutrina e na jurisprudência. Analisa-se, em um primeiro momento, as teorias acerca da natureza da personalidade jurídica, bem como o panorama da responsabilidade no direito alienígena. Discute-se a responsabilidade penal da pessoa jurídica em questões ambientais, tomando como base os pressupostos estabelecidos na Carta Magna brasileira e na legislação penal. Discute-se aspectos pertinentes ao referido instituto na Lei 9.605/98, colacionando e analisando, por fim, julgados e denúncias sobre a matéria.

ABSTRACT

The present work treats of the penal responsibility of the legal entities in the Environmental Right, fear that, although welcomed by the Federal Constitution of 1988, it still generates multiple discussions in the doctrine and in the jurisprudence. It is analyzed, in a first moment, the theories concerning the nature of the juridical personality, as well as the panorama of the responsibility in the alien right. The penal responsibility of the legal entity is discussed in environmental subjects, taking as base the established presuppositions in the Brazilian Great Letter and in the penal legislation. It is discussed pertinent aspects to the referred institute in the Law 9.605/98, collating and analyzing, finally, judged and accusations on the matter.
