RESUMO
Os constantes avanços da biotecnologia fazem surgir na sociedade contemporânea novas e controversas questões éticas. Para que seja possível solucionar de modo satisfatório as situações que surgem cotidianamente, fundamental o respeito aos princípios bioéticos básicos – autonomia, beneficência e justiça. Entretanto, há casos em que a aplicação desses princípios não é suficiente, e se torna necessário encontrar um fundamento orientador que abarque todas as situações fáticas que se apresentam. Nesse sentido, o presente artigo tem por objetivo analisar a importância da poderação de princípios e a contribuição da argüição do principío da dignidade humana na solução de Conflitos bioéticos, tais como o contrato de maternidade de substituição. Os resultados permitem concluir que o principío da dignidade humana deve fundamentar toda e qualquer decisão, não apenas em questões bioéticas, mas em todo o direito, bem como verificar o melhor interesse da criança, sempre.

ABSTRACT
The Constant advances of the biotechnologiy make to appear in the cosiety contemporany new and controverse ethical questions. So that it is possible to solve in satisfactory way the situations that appear daily,the respect to the basic bioethics principies is fundamental – autonomy, beneficence and justice.
