O trabalho inicia-se com breve demonstração de que a indenização do dano moral é garantia constitucional de todos e não pode ser excluída de nenhuma áre a do
Direito interno e de nenh uma relação jurídica interna , nem mesmo do Direito de
Família e das relações de família. Prossegue com demonstração do cabimento do da no moral e material no Direito de Família. Em se guida fa z a notaçõ es sobre a dou trinalização e a jurispruden cializaç ão d o Direito de Família atu al. Depois traz anotações sobre culpa conjugal e culpa civil. Faz distinções entre conflito conjugal, litígio conjugal, litígio judicial, culpa conjugal e culpa civil, com breves distinções entre lei psicanalítica e lei jurídica. Procura demonstrar que o Direito não pode fazer uso perverso da Psicanálise e conclui que a infidelidade conjugal pode gerar indenização por dano moral.

He/she makes distinctions among matrimonial conflict, matrimonial litigation, judicial litigation, accuses matrimonial and it accuses civil, with brief distinctions between norms of the psychoanalysis and juridical norms.
