Democracia, Direitos Humanos e Cidadania: as "novas políticas de reconhecimento" e os impasses na judicialização da questão social

Resumo: A pressão dos movimentos sociais pelo reconhecimento dos direitos de identidades sociais tem ampliado a concepção da justiça social, que passou a inserir as demandas por respeito às diferenças, considerando simultaneamente as necessidades dos grupos sociais. Essas mudanças incidem sobre a elaboração e execução das políticas públicas, que passam a tomar os direitos humanos como principal referência. Este artigo tem o objetivo de identificar os efeitos das políticas dos direitos humanos nas democracias contemporâneas, considerando a possibilidade de realização de uma nova forma de justiça social, defendida por Nancy Fraser e Boaventura Santos, mas fortemente criticada por
Marcel Gauchet.

Democracy and social justice in the contemporary days: contributions and critics the politics of human rights
Abstract: The pressure of the social movements for the recognition of the rights of social identities has been enlarging the conception of social justice, that has included the requests for public respect to the differences, considering the needs of the social groups simultaneously. Those changes have consequences upon the elaboration and execution of the public politics, that start taking on the human rights as main references. This article aims to identify the effects of the politics of the human rights in the contemporary democracies, considering the possibility of accomplishment in a new way of social justice, defended by Nancy Fraser and Boaventura Santos, but strongly criticized by
Marcel Gauchet.
