O “BULLYING” E SUAS IMPLICAÇÕES NO CONTEXTO ESCOLAR

RESUMO: Este estudo pretende abordar a ocorrência do fenômeno denominado “bullying” no ambiente das escolas. Procura-se conceituá-lo e evidenciar as características que o distinguem de outros tipos de violência. Após um panorama sobre sua ocorrência, pretende-se lançar algumas perspectivas de enfrentamento dessa violência recorrente no ambiente acadêmico atual. Por outro viés, analisam-se as repercussões no âmbito legal e social da prática do “bullying”, de forma especial, sua caracterização como infração penal, quando praticado por maior de 18 anos, ou como ato infracional, quando praticado por maior de 12 e menor de 18 anos. Defende-se a mediação escolar como a melhor estratégia para o tratamento do “bullying” nas escolas, trazendo à baila a polêmica sobre o papel do professor em face da ocorrência desse fenômeno.

ABSTRACT: This study aims to address the occurrence of the phenomenon called "bullying", especially in the environment of schools. It intends to highlight it and conceptualize the characteristics that distinguish it from other types of violence. After an overview of its occurrence, is to launch some perspectives for dealing with this recurring violence in academia today. For another perspective, we analyze the impact on the legal and social practice of "bullying", especially, its characterization as a criminal offense when committed by more than 18 years old, or as an offense, when practiced by over 12 and younger than 18 years old. It supports the school mediation as the best strategy for the treatment of "bullying" in the schools.
