Curso de DIREITO EMPRESARIAL III – COMPRA E VENDA MERCANTIL

RESUMO: O presente estudo tem por desígnio o cotejo analítico dos artigos 481 a 504 CC, que trata da compra e venda que tem por objeto coisa atual ou futura, com o tratamento dado ao tema pelo Código Civil de 2002. Analisando a natureza jurídica de compra e venda mercantil realizada entre empresários essa já é uma distinção entre a compra e venda cível e a mercantil. E as obrigações entre o vendedor e o comprador, analisando os elementos essenciais do contrato e suas cláusulas especiais, dentre formação e execução, elementos do contrato, obrigações da parte, reserva de domínio e cláusulas internacionais usuais. Interessa observar que o estudo é voltado também à perquirição da semelhança na regulamentação jurídica entre compra e venda cível e mercantil, que são completamente diferentes nas relações interpessoais as funções de uma difere da outra.
