RESUMEN |
La constitucionalización de los derechos sociales se sitúa en la encrucijada entre las exigencias de la democracia y las demandas de la justicia distributiva, dos cuestiones fundamentales de la filosofía política contemporánea cuya conexión ha sido indebidamente ignorada. En este trabajo se sostiene que estas dos importantes cuestiones están relacionadas y que, por lo tanto, es posible que surjan conflictos entre ellas. En particular, la protección robusta de los derechos sociales debe dar cuenta de las objeciones contrademocráticas que pesan de manera especial sobre el control judicial de constitucionalidad de las exigencias de la justicia distributiva. The constitutional protection of social rights is situated at the crossroads between the requirements of democracy and the demands of distributive justice, two leading issues in the contemporary political philosophy whose connection has been unduly neglected. In this paper I maintain that more attention must be given to the interaction of these two fundamental issues, especially where conflicts emerge.
