NOVO CONSTITUCIONALISMO NA AMÉRICA LATINA: UMA
OPÇÃO À DEMOCRACIA BRASILEIRA

RESUMO
O presente trabalho analisará o fenômeno do Novo Constitucionalismo na América
Latina, intentando compreender como este pode servir de opção à melhor efetivação do
Estado Democrático de Direito da República Federativa do Brasil, surgido com a Constituição
Federal de 1988. Para tanto, busca, no Direito Comparado, compreender historicamente o fluxo de adventos e alterações constitucionais recentes na região latino-americana, em suas similitudes e distinções. Adiante, analisa brevemente o caso particular brasileiro, apontando questões relevantes relacionadas ao exercício democrático no País, para, ao fim, entender que alguns dos conceitos comuns trazidos no bojo das constituições da América Latina, sobretudo as mais recentes, podem apontar para soluções viáveis à problemática vislumbrada, de não realização plena do regime democrático no Brasil.

ABSTRACT
This paper will examine the phenomenon of the new Constitutionalism in Latin America, trying to understand how this can serve as a option to better effectuation of the Democratic
State of Law of the Federative Republic of Brazil, emerged with the Federal Constitution of
1988. To do so, search, in Comparative Law, understand historically the flow of advents and recent constitutional changes in the Latin American region, in their similarities and distinctions. Further analyses briefly the case in Brazil, pointing out relevant issues related to the democratic exercise in the country, to the end, understand that some of the common concepts brought into constitutions bulge of Latin America, especially the latest, may point to viable solutions to the problem envisioned, not carrying out full of democratic regime in
Brazil.
