RESUMO

ABSTRACT

O presente artigo discorre acerca da importância da utilização do Direito como instrumento para evitar e dirimir conflitos decorrentes da prática do bullying escolar. Para tanto se conceituou o que é bullying e se analisou quais as legislações que se aplicam no combate e punição aos bullies, de onde se extraiu a aplicabilidade da Declaração Universal dos Direitos
Humanos, da Constituição Federal, do Código Civil e do Direito da Criança e do Adolescente. Contudo, se identificou a inexistência de leis federais específicas, o que reforça a necessidade do Poder Legislativo brasileiro criar mecanismos capazes de combater e bem punir tal mazela social, amenizando as consequências psicológicas desenvolvidas pelas vítimas e especialmente no intuito de desmotivar tais condutas. This article talks about the importance of using the
Law as an instrument to prevent and resolve conflicts arising from the practice of school bullying. For that conceptualized what is bullying and examined what the laws which apply in combating and punishing the bullies, from where extracted the applicability of the
Universal Declaration of Human Rights, the Federal
Constitution, the Civil Code and the Law of the Child and Adolescents. However, it was identified the absence of specific federal laws, which reinforces the need for the Brazilian Legislature create mechanisms able to combat and punish such social blemish, softening the developed psychological consequences for the victims and especially in order to discourage such conduct.
