PRISÃO CIVIL: PRISÃO DO DEPOSITÁRIO INFIEL

RESUMO

Este trabalho objetiva apresentar o estudo sobre a aplicação do instituto da prisão do depositário infiel. Especificamente, caracterizou-se o depositário, examinou-se a constitucionalidade da prisão civil, bem como o enquadramento dos tratados ratificados pelo Brasil. A metodologia utilizada para este estudo foi a pesquisa bibliográfica e pesquisa documental. Nos capítulos que se seguem foram discutidas as leis e a jurisprudência sobre o assunto, com enfoque para a viabilidade no uso contemporâneo do instituto estudado.

ABSTRACT

This paper aimed to present the study on the implementation of the depository institution of the prison unfaithful. Specifically, characterized by the depositary, it examines the constitutionality of the civil prison, and the framework of the treaties ratified by Brazil. The methodology used for this study was the literature search and document retrieval. In the chapters that follow were discussed laws and jurisprudence on the subject, with a focus to the contemporary viability of the use of the institute studied.
