EUTANÁSIA E COERÊNCIA NORMATIVA NO ESTADO DEMOCRÁTICO DE DIREITO E NA PÓS-MODERNIDADE

RESUMO

Este trabalho apresenta a análise por volta do conceito de Estado Democrático de Direito na pós-modernidade caracterizada por um mundo fragmentado, com a desconstrução de princípios, conceitos e sistemas construídos na modernidade, desfazendo todas as dependências que foram impostas ao homem moderno. O estudo proposto também tem em vista possuir um conhecimento sob o prisma jurídico e ético da eutanásia, fazendo assim, um enfoque voltado á dignidade da pessoa humana, dos direitos fundamentais atribuídos a Carta Magna bem como de aspectos criminais, ressaltando que o tema é de relevância social, moral, ético, religioso e jurídico e a reflexão sobre o valor das ações sociais relacionada com o sentimento de justiça social, consideradas tanto no âmbito coletivo como no âmbito individual.

ABSTRACT

This article presents the analysis of the concept of the Democratic State of Law during the post-modern age. Characterized by a fragmented world, with the deconstruction of principles, concepts and systems built in the modern era, vanishing the bonds imposed on the modern man. This study also intends to explore the legal and ethical perspectives of the euthanasia. Doing so, an approach focused on the dignity of the human being, the fundamental rights described in the Charter and the criminal aspects, emphasizing that the theme is relevant socially, morally, ethically, religiously and legally and the refletion of the value of social actions associated with the feeling of social justice, being considered both on the collective and individual scopes.
