ANÁLISE CRÍTICA DO LIVRO “A PROBLEMÁTICA DA TEORIA MORAL E JURÍDICA” DE RICHARD A. POSNER

RESUMO

O texto visa analisar a posição de Posner sobre a teoria moral e comparar tal visão com a de outros estudiosos do direito, principalmente Dworkin. O foco do artigo é a importância dessa teoria e sua aplicação no ensino nas universidades, assim como no julgamento de casos difíceis. Contesto a visão pragmática de Posner, que embora possa parecer bastante atrativa à primeira vista, é insuficiente para julgar casos em que é necessário um raciocínio moral mais amplo. Busco ainda ratificar a concepção de que a moral é essencial ao direito, e que apesar do uso de conhecimentos de outras áreas possa auxiliar na decisão de alguns casos, é essencial nunca transformá-los na única fonte confiável em um julgamento.

ABSTRACT
The text aims to analyze the position of Posner on moral theory and compare that view with other legal scholars, especially Dworkin. The focus of the article is the importance of this theory and its application in education in universities, as well as in the judgment of hard cases. I contest the pragmatic view of Posner, because although it might seem very attractive at first sight, it is insufficient to judge cases in which you need a broader moral reasoning. I intend to ratify the idea that morality is essential to law, and, even though the use of knowledge from other areas can help decide some cases, it is essential never turn them into the only reliable source in a judgment.
