CONSTITUCIONALIDADE DA INSPEÇÃO NA INVESTIGAÇÃO DE CONDUTAS ANTICOMPETITIVAS SOB A ÉGIDE DA LEI N.º 12.529/2011

RESUMO

O presente trabalho tem por finalidade apresentar uma ferramenta de investigação, disposta na Lei de Defesa da Concorrência – Lei n.º 12.529/2011 – que pode ser utilizada pelo Conselho Administrativo de Defesa Econômica – CADE – durante a investigação de condutas anticompetitivas; a inspeção. Por meio da inspeção o CADE, no interesse da instrução do processo de investigação, pode visitar a sede, estabelecimento, escritório, filial ou sucursal de empresa investigada, facultando-lhe examinar estoques, objetos, papéis de qualquer natureza, livros comerciais, computadores e arquivos eletrônicos, podendo, ainda, extrair ou solicitar cópias de quaisquer documentos ou dados eletrônicos, independente de autorização judicial. Enfrentada esta primeira fase, verificar-se-á a compatibilidade da inspeção com o ordenamento jurídico vigente, em especial, com direitos fundamentais tais como a inviolabilidade de domicílio, o sigilo de dados, a direito de não gerar provas contra si e o devido processo legal.

CONSTITUTIONALITY INSPECTION OF RESEARCH IN ANTICOMPETITIVE CONCUCT UNDER THE AEGIS OF LAW No. 12.529/2011

ABSTRACT:

This work aims at presenting a investigation tool, arranged in Antitrust Law – Law no. 12.529/2011 – that can be used by the Administrative Council for Economic Defense – CADE – during the investigation of anticompetitive conduct; inspection. Through inspection the CADE, in the interest of instruction of the investigation process, can visit the headquarters, establishment, office, branch or subsidiary company investigated, providing you examine inventories, objects, papers of any kind, trade books, and computers electronic files, and can also extract or request copies of any documents or electronic data, regardless of a judicial warrant. After this first phase, it will check the compatibility of the
