O SISTEMA AFRICANO DE PROTEÇÃO DOS DIREITOS HUMANOS E DOS

RESUMO
O presente artigo discute, de maneira profunda e crítica, o Sistema Africano de Proteção dos Direitos Humanos e dos Povos. Para tanto, debate, inicialmente, a origem e a formação histórica do sistema africano, a partir, sobretudo, da criação da Organização da Unidade Africana – OUA (atual União Africana – UA) e da entrada em vigor da
Carta Africana sobre Direitos Humanos e dos Povos. No âmbito deste sistema, as duas principais instituições que se destacam na tarefa de proteger e defender os direitos humanos e dos povos na África são a Comissão e a Corte Africana de Direitos Humanos e dos Povos. Dentro desta perspectiva, o trabalho investiga e analisa suas competências consultivas e contenciosas, bem como os procedimentos e mecanismos criados por seus respectivos estatutos na busca de se estabelecer meios que possibilitem, de modo efetivo, a concretização e o resguardo da proteção dos indivíduos no continente. É elaborada, ainda, uma discussão acerca das convergências e incongruências da criação da Corte Africana de Justiça em relação às já existentes instituições de cunho jurisdicional do sistema.

Human and Peoples’ Rights Protection. In this manner, it debates, initially, the origin and historical background of the African system, starting with the creation of the
