CONCRETIZAÇÃO DOS DIREITOS FUNDAMENTAIS

RESUMO
A proposta deste trabalho é de uma Hermenêutica Constitucional que concretize os Direitos Fundamentais e viabilize a edificação do Estado Democrático de
Direito. Certamente caberá à Hermenêutica Constitucional concretizar os direitos que o fundamentam. É mister, portanto, que se apreenda o significado desse modelo estatal e que há dois pilares em que ele se apóia: a Democracia e os Direitos Fundamentais. Por isso, analisa-se a função da Hermenêutica Constitucional para a concretização dos direitos fundamentais. Nesse sentido, o juiz, como um dos intérpretes da Constituição, deve estar apto a trabalhar com princípios e com o problema concreto e deixar de ser mero aplicador de leis. Na concretização dos Direitos Fundamentais, devem ser utilizados como critérios os princípios da interpretação constitucional, especialmente os indicados por Konrad Hesse. Postula-se, assim, uma Hermenêutica Constitucional para a concretização dos direitos fundamentais.

ABSTRACT
The proposal of this work is a Constitutional Hermeneutics which materializes the Fundamental Rights and makes possible the construction of the Democratic State of
Right. Materialize those rights is a task of Constitutional Hermeneutics. It is necessary to understand the meaning of this state model and that it has two pillars: Democracy and Fundamental Rights. Thus, the function of the Constitutional Hermeneutics for the effectiveness of the fundamental rights in the Democratic State is analyzed. Therefore, the judge, as one of the interpreters of the Constitution, must be able to work with principles and the concrete problem and is not a mere applicator of laws. In new hermeneutics, the principles of the constitutional interpretation are used as criteria, especially the ones indicated
