A fase ordinatória do processo civil no rito ordinário Resumo: A fase ordinatória tem início logo após a fase postulatória, ou seja, depois de transcorrido o prazo de resposta do réu. Tal fase é denominada ordinatória porque é o momento em que o juiz irá decidir o caminho a ser seguido, levando em consideração os argumentos até então aduzidos pelas partes na fase postulatória, visando à instrução e julgamento do feito. É de suma importância destacar que os atos saneadores não estão confinados exclusivamente à fase ordinatória. Além disso, nessa fase, certos atos visam não propriamente o saneamento do feito, mas a sua extinção. É dever do julgador mapear eventuais irregularidades, saneando o processo ou extinguindo-o sem julgamento de mérito, se as irregularidades forem insanáveis e impedirem o prosseguimento do feito. Assim, o presente estudo visa delinear a fase ordinatória do processo civil no rito ordinário, levando em consideração a sistemática imposta pelo Código de Processo Civil, numa visão crítica e construtiva.
