A filiação afetiva é amor e carinho recíprocos de pai e filho não consanguíneos, gerando um parentesco civil devido à sua característica de “posse de estado de filho”, resultando um papel secundário à verdade biológica. Em suma, é uma filiação psicológica, mas que detém todas as responsabilidades inerentes do poder familiar. Seu reconhecimento, além de ser uma garantia constitucional da dignidade da pessoa humana e do melhor interesse da criança, também garante todos os direitos sucessórios; como pedir alimentos; pleitear e gozar herança; propor ação de nulidade de partilha.

ASSUMPTIONS OF FATHERHOOD AFFECTIVE RELATIONSHIPS
ABSTRACT: A sonship affective is love and affection reciprocal of father and son non-consanguineous, generating a kinship civil because of its characteristic of "possession of state of son", resulting in a secondary role to true biological. In short, it is an sonship psychological, but it holds all the responsibilities inherent in family power. Its recognition, in addition to being a constitutional guarantee of the dignity of the human person and of the child's best interest, it also ensures all rights of inheritance; as ask foods; plead and enjoy inheritance; propose action of invalidity of sharing.
