OS MOLDES DO INSTITUTO DA USUCAPIÃO E SUA APLICAÇÃO NO ORDENAMENTO JURÍDICO BRASILEIRO

Resumo: Este trabalho tem como finalidade analisar toda a evolução histórica desde sua origem até aos dias atuais, bem como estudar as espécies e requisitos dos meios de aquisição de posse provenientes da usucapião, abordando as demais leis presentes no ordenamento jurídico brasileiro que regulam esta modalidade, e tentando esclarecer um pouco mais sobre este velho instituto de aquisição de posse, que ainda é muito utilizado pelos cidadãos nos dias de hoje. Primeiramente, é exposto a origem do termo usucapião, os tipos de usucapião existentes, e sua previsão no Ordenamento Jurídico Brasileiro. Logo em seguida, é descrita a grande evolução deste instituto até aos dias atuais, e posteriormente é abordada um pouco mais a fundo as espécies de usucapião. Após isso, é visto os pressupostos referentes a este instituto e como se da a sentença judicial proferida pelo juiz.

Abstract: This work aims to analyze the whole historical evolution from its origins to the present day, as well as studying the species requirements and the means of acquiring ownership from adverse possession, addressing other laws present in the Brazilian legal system governing this mode, and trying to clarify a bit more about this old institute acquisition of office, which is still widely used by people nowadays. First, it exposed the origin of the term adverse possession, the types of adverse possession, and its forecasting in the Brazilian legal system. Shortly thereafter, we describe the evolution of this great institute up to the present day, and is subsequently addressed a bit further the species of usurpation. After this it is seen assumptions about the institute and how the judicial verdict of the judge.
