A Lei de Talião e o princípio de igualdade entre crime e punição na Filosofia do Direito de Hegel

If Lex talionis seems to us today a cruel and barbarian law, which describes better revenge than the need of punishment following justice, we should notice however, that this statement is also grounded in a balanced relatioship between crime and punishment. The aim of this paper is to search for the need of an exact relationship between the denying and the reestablishment of justice, following Lex talionis statement.
However, specific equality and equality of value cannot be mistaken. Equality of value is enough to provide justice at the theoretical level, but not when it is extended to the practical level. At the practical level equality can only be obtained in terms of quantity and quality that vary according to culture and time. Thus, the practical level should be as a mirror of the theoretical one following the demands of reason. In Hegel, this procedure is possible due to free spirit self determination, which means the unity of theoretical and practical realms.
