Trabalhos feitosAbstract: The study deals amnesty especially in the case of the Araguaia Guerrilla, in the period of the military coup of 1964, seeking to demonstrate the reality, validity and effectiveness of Law nº 6.683/79. And, aims to demonstrate the phases of the military dictatorship, through constitutional development to achieve democracy, examines the state's responsibility before the crimes committed by state agents, conceptualizing the institute amnesty to clarify its validity and the proportion of their reach and effects against the oppressors and the oppressed. We present the decisions taken by the Brazilian government in relation to the facts and crimes that have occurred mostly in the Araguaia Guerrilla as well as the responsibility of the Federative Republic of Brazil before the Inter-American Commission and the Inter-American Court of Human Rights for violating the legal provisions of the American Convention. However, the determinations of international bodies have not been met by the country generating reflection in the international community.

Resumo: O estudo em pauta trata da anistia em especial no caso da Guerrilha do Araguaia, ocorrida no período do golpe militar de 1964, buscando demonstrar a realidade, eficácia e validade da Lei nº 6.683/79. E, tem como finalidade demonstrar as fases da Ditadura Militar, passando pela evolução constitucional até chegar à democracia, analisa a responsabilidade do Estado ante os crimes cometidos pelos agentes estatais, conceituando o instituto da anistia a fim de esclarecer sua validade e a proporção de seu alcance e efeitos perante os opressores e oprimidos. Foram apresentadas as decisões tomadas pelo governo brasileiro em relação aos fatos e crimes ocorridos principalmente na Guerrilha do Araguaia, bem como a responsabilidade da República Federativa do Brasil perante a Comissão Interamericana e a Corte Interamericana de Direitos Humanos por infringir os preceitos legais da Convenção Americana.
