RESUMO
O presente ensaio pretende abordar o tema relativo à hermenêutica constitucional. Investigar-se-à se existe uma relação necessária entre constitucionalização do direito, direitos e garantias fundamentais e decisionismo judicial no processo civil brasileiro. O método empregado foi o dedutivo. A técnica de pesquisa foi a bibliográfica, com uma apresentação interdisciplinar. Aborda-se, em uma primeira fase, a identificação dos direitos e das garantias fundamentais no texto constitucional. Em uma segunda fase, analisa-se a estrutura normativa dos direitos e das garantias fundamentais, com ênfase no modelo fundamental adotado pelo sistema normativo brasileiro. Por fim, afere-se a possibilidade de concretização ótima dos direitos e das garantias fundamentais pela atuação do Poder Judiciário no processo civil brasileiro.

The aim of this paper is to approach the issue of constitutional hermeneutics. We will investigate if there is a necessary relationship between constitutionalization of law, fundamental rights and guarantees and judicial decisionism at Brazilian civil procedure. The method used was the deductive one. The research technique was the bibliographical with an interdisciplinary presentation. Regarding the work plan, it was initially decided to identify the fundamental rights and guarantees.
