RESUMO
Esse trabalho nasce com o escopo principal de abordar o estudo das interfaces existentes dentro da Literatura e o Direito, mas precisamente no que concerne a um direito menos positivado. O Direito contado a partir da literatura, um modo de pensar o direito que difira do positivismo jurídico, e que ajude a se alcançar novos patamares intelectuais, deixando como critério de adoção ou não, o senso de justiça do leitor. Além de buscar reflexões jurídico-literárias, cujo eixo temático é marcado por questões que atravessam tanto o direito como a literatura. No fim das contas usa-se como peça-exemplo, em um segundo plano, a obra Medida por Medida de Willian Shakespeare, permitindo assim as mais diversas e profundas reflexões: a legitimidade do governador e das suas leis e o abuso de direito, entre tantas outras.

LAW AND LITERATURE: THE LAW BEHIND SHAKESPEARE

ABSTRACT
This work was created with the main aim of approaching the study of interfaces within the existing literature and law, but specifically with respect to less positivado law. The Law counted from the literature, a way of thinking that differs from the law of legal positivism, and to help reach new intellectual heights, leaving as a criterion for adoption or not, the sense of justice of the reader. Besides seeking legal and literary reflections, whose main theme is marked by issues that cross both the law and the literature. In the end use as Part-example, in the background, the work Measure for Measure by William Shakespeare, thus allowing the most diverse and profound reflections: the legitimacy of the governor and of its laws and the abuse of law, among many other.
