DANO MORAL DECORRENTE DE ABANDONO AFETIVO

RESUMO: O presente trabalho propõe-se a indagar sobre a possibilidade de caracterização do dano moral diante de hipótese de abandono afetivo dos filhos por parte do genitor. Para tanto, haverá um enfoque no instituto da família, sua evolução histórica, seus princípios e a consideração da criança e do adolescente como sujeito de direitos. Em seguida, enfatizar-se-ão os deveres inerentes ao poder familiar, ressalvando a proteção garantida à criança e ao adolescente. Posteriormente, serão examinados os elementos da responsabilidade civil e sua aplicação no abandono afetivo. Neste sentido, será contemplada a possibilidade do dano moral incidir como forma de compensação para o ofendido. Por fim, será objeto de análise a questão do afeto nos tribunais pátrios, o entendimento esposado pelo Superior Tribunal de Justiça e, finalmente, o dano moral decorrente de abandono afetivo.

ABSTRACT: This paper proposes to inquire about the possibility of characterizing the damage before the hypothesis of emotional child by the parent. Therefore, there will be a focus at the institute of the family, its historical development, its principles and consideration of children and adolescents as subjects of rights. Then it will emphasize the duties of the family power, safeguarding the protection afforded to children and adolescents. We will then examine the elements of liability and its application in affective abandonment. In this sense, will be contemplated the possibility of damage cover as compensation to the victim. Finally, it will be analyzed the issue in the courts patriotic affection, understanding espoused by the Supreme Court, and finally the moral damages of emotional.
