CONSTITUIÇÃO SUPRANACIONAL: UMA INTERNACIONALIZAÇÃO
DO DIREITO CONSTITUCIONAL?

RESUMO
Tradicionalmente, a ideia de poder constituinte remete o constitucionalista clássico (aquele dos tempos de Sieyès, Rousseau e Montesquieu) a uma incondicionalidade e à consequente conclusão de que o poder constituinte originário tudo pode. Esta é a primeira exposição feita no presente texto científico, a qual é esvaziada adiante, quando é exposto o caso do poder constituinte que vem ocorrendo fora dos moldes tradicionais no contexto da União Europeia e do próprio Direito
Internacional no mundo globalizado, razão pela qual o Tratado Internacional é aqui introduzido como um instrumento produtor de normas que obrigam a Comunidade
Internacional na mesma medida que as leis obrigam as instituições e o povo dentro dos parâmetros soberanos de um Estado-nação.
Na conclusão do que aqui se escreve, fica a pergunta: estaríamos caminhando rumo a uma realidade de um mundo sem Estados ou de um Estado global?

SUPRANATIONAL CONSTITUTION: INTERNATIONALIZATION OF CONSTITUTIONAL LAW?
Traditionally, the idea of constitution making power is unlimited: there would not exist, accord to this theory from the times of Sieyès, Rousseau and Montesquieu, any limits to the political manifestation of constitution making power. This idea does not keep itself alive beyond the reality of International Public Law, above all beyond the reality of the new supranational constitutionalism found at the European Union.
At the end of the present cientific research, there are the conclusions the
International Treaties and the new constitutionalism have created on our minds the following question: will there be o world without states or will there be a global state? 1
