ALIENAÇÃO PARENTAL: ASPECTOS JURÍDICOS ACERCA DA EFICÁCIA DA LEI 12.318/2010

RESUMO

O presente artigo versa sobre o instituto da alienação parental previsto na Lei n. 12.318 de 26 de agosto de 2010, o qual compreende os direitos da criança e adolescente, definindo o conceito da alienação parental, sua coibição e prevenção. Diante do envolvimento do tema com o direito de família, busca-se ressaltar as obrigações de ambos os genitores para com seus filhos, transcorrendo em meio à guarda compartilhada como forma de minimizar a prática da alienação. No decorrer do trabalho dar-se-á ênfase a síndrome de alienação parental e sua distinção com a alienação. Em vista da complexidade do tema no âmbito social e jurídico, busca-se demonstrar a importância do Poder Judiciário em desvendar e solucionar os casos de alienação parental, a fim de concluir se a Lei n.12.318/2010 quando aplicada, apresenta ou não eficácia no ordenamento jurídico brasileiro.

ABSTRACT

This article focuses on the institution of parental alienation provisions of Law n. 12.318 of August 26, 2010, which comprises the rights of children and adolescents, defining the concept of parental alienation, their deterrence and prevention. Given the involvement of the subject with family law, seeks to emphasize the obligations of both parents to their children, spending amid custody in order to minimize the practice of alienation. During the work will give emphasis on parental alienation syndrome and its distinction from the sale. Given the complexity of the topic in the social and legal, we seek to demonstrate the importance of the judiciary in uncovering and addressing cases of parental alienation in order to conclude whether the Law n.12.318/2010 when applied, or has not effectively the Brazilian legal system.
