Resumo: A fim de que as decisões judiciais sejam desafiadas, recusadas ou apoiadas, cabe ao magistrado justificar as razões que o levaram a decidir desta ou daquela maneira. A falta de clareza na justificação das razões que fundamentaram a decisão judicial diminui ou, em última análise, inviabiliza a possibilidade de controle do comando judicial. O estudo da jurisprudência pátria, em especial aquela construída pelo Supremo
Tribunal Federal, revela, contudo, uma série de incongruências, apontando, ainda, a presença de falácias no respectivo discurso. Visando comprovar a afirmação, visitamos a jurisprudência do Supremo Tribunal
Federal, em especial o Recurso Extraordinário nº 597-270-4/RS, apontando as falácias nele presentes, com base no modelo argumentativo sugerido por Manuel Atienza, em obras como As razões do direito: teorias da argumentação jurídica e Curso de Argumentación Jurídica.

Abstract: In order that judgments are challenged, supported or rejected, it is up to the magistrate to justify the reasons that led him to decide one way or another. The lack of clarity in the statement of reasons on which the decision or judicial decreases, ultimately, prevents the possibility of judicial control command. The study of jurisprudence country, especially one built by the Supreme Court, however, reveals, besides the style often arrevesado and wordy, a number of inconsistencies, pointing also to the presence of fallacies in their speech.
